TERMS AND CONDITIONS

1. General Conditions – Application

1.1 These Terms and Conditions (“Agreement”) apply to all services offered by Esperia Volleyball Academy LLC (“Esperia”), including but not limited to:

Volleyball classes (indoor and beach, for adults and minors)
Camps, events, and tournaments
Court rentals (standard and long-term)
Games and recreational play
Other related services.

1.2 This Agreement supersedes all previous agreements and constitutes the entire understanding between the Client and Esperia. Any variation shall only be valid if made in writing and signed by a duly authorized officer of Esperia.
1.3Rates are published on https://www.volley.ae. Discounts or ad hoc quotations may be applied at Esperia’s discretion. Such rates are confidential and must not be disclosed to third parties.

2. Booking and Payments – Court Rentals

2.1 Bookings must be made and paid for in advance through the official platforms
2.2 Walk-in Clients may pay by cash or card at the venue office before the session.
2.3 Bookings are valid only if completed via the official online booking systems. Requests via phone, chat, or other channels will not be accepted.
2.4 Sub-renting, resale of time slots, or hosting commercial activities without prior written approval from Esperia is prohibited. Display of third-party banners or logos also requires prior approval.
2.5 Rescheduling is permitted only within the timeframe and channels designated by Esperia. Refunds are not provided under any circumstances.
2.6 In case of weather conditions such as wind exceeding 30kph, bookings may be rescheduled according to Esperia rules, but not refunded. The rescheduled session must take place within the timeframe determined by Esperia. It is the client's responsibility to check the weather forecast and reschedule the session in advance.
2.7 Each Client or group is limited to a maximum number of rental hours per day, depending on membership tier. Use of multiple accounts to bypass this rule may result in cancellation of bookings and accounts.
2.8 Clients must:

Enter/exit through the main entrance;
Do not climb or damage fences.
Keep the venue clean and dispose of waste in bins.
Refrain from smoking on-site.
Avoid moving nets, lines, or equipment without Esperia staff approval.

3. Booking and Payments – Adult Classes

3.1 Class payments must be made prior to participation by card (POS, link) or online via https://www.volley.ae.
3.2 Clients must manage their bookings, rescheduling, or cancellations through their personal member area.
3.3 If Esperia cancels a class, a credit will be added to the Client’s profile
3.4 Classes require a minimum number of participants to run. Esperia reserves the right to reschedule or cancel if numbers are insufficient.
3.5 Package Freeze Policy

Long-term packages may be frozen once per calendar year, up to 3 months.
Four-session packages are excluded unless supported by a valid medical certificate.
Additional freezes may be granted for injuries upon submission of a medical certificate.
All freeze requests must be submitted in writing and approved by Esperia.

4. Booking and Payments – Minor Classes

4.1 Payments must be made by parents or legal guardians before the start of sessions.
4.2 Discounts (e.g., early bird, sibling) are non-refundable.
4.3 Refunds are available only for injury (with a medical certificate) or force majeure events, subject to a 20% administrative fee deduction.
4.4 Make-up lessons are permitted within the same term, subject to coach/admin approval.
4.5 Make-up lessons are not granted for single absences, family travel, or scheduling conflicts with other activities.

5. General Disclaimer – Participation and Venue Access

5.1 Open Beach Venue Disclaimer.
Esperia operates courts at Kite Beach, which is a public beach area. Esperia takes reasonable care to clean and inspect its courts; however, it cannot fully prevent the presence of foreign objects due to the open nature of the beach environment.
By entering or participating, Clients and Players acknowledge and accept that they do so entirely at their own risk.
Participation in any activity involves inherent risks of injury. Clients are strongly advised to hold valid personal sports insurance covering activities in the UAE.

5.2 Esperia is not liable for:

Personal injury, accident, or death;
Loss or damage to personal property;
Any incident arising from hazards in the sand or open environment.

5.3 Additional conditions of entry and use:

Children under 12 must be supervised at all times.
No sharp objects, glass, food, skateboards, bicycles, scooters, or pets are allowed on the courts.
Smoking and alcohol are prohibited.
Abusive behavior toward staff or players will result in removal and possible ban.
Clients consent to images, videos, and recordings being used for promotional purposes by Esperia.

6. Use of Images and Marketing

6.1 By registering or participating, Clients consent to the use of their (or their child’s) name, image, likeness, and performance in photos, videos, and promotional materials produced by Esperia and its authorized partners.

6.2 Clients may opt out of receiving third-party promotional material by written request.

7. Website Terms and Conditions

Your access to and use of the Esperia Volleyball Academy LLC website and applications is subject to the following terms and conditions, in addition to applicable laws and regulations in the United Arab Emirates. By accessing the Website, you agree to these terms and conditions, whether you are a registered user or not. Your browsing and use of the Website mean you have unconditionally accepted these terms and conditions.
Esperia Volleyball Academy LLC reserves the right to amend the terms and conditions of use of this Website and you agree to be bound by these amendments. Please note that other websites and pages linked to this Website may be subject to separate terms and conditions. Please visit the respective websites to view their terms of conditions.
7.1 Conduct and Behavior
You agree to access and use the Website for lawful purposes only, and to be fully responsible for your knowledge of and compliance with all laws, regulations, and rules regarding your use of the Website. Just by accessing the Website, you agree not to perform any of the following:

Use of the Website for the purpose of committing a crime or encouraging others to engage in any conduct that would lead to committing a crime or involves civil liability
Publishing or posting of any unlawful content that includes discrimination, defamation, libel, slander, obscene material, pornographic material, or any other unlawful topic
Use of the Website to impersonate other parties or entities
Use of the Website to upload any material containing software viruses, Trojans, or any other codes, files, or software that may alter, destroy, or stop the functions of the Website, devices, or software belonging to any other person who may access the Website
Uploading, entering, emailing, or copying of any material you are not entitled to send under any law or contractual relationship
Alteration, destruction, or deletion of any content posted on the Website
Disruption or impedance of normal communication channels in any way possible
Claiming a relationship with or representation of any company, association, or organization without being authorized to do the same
Posting or sending of any advertisements, unwanted marketing material, or any other form of promotion
Posting of any materials that violate or interfere with the Intellectual Property Rights of others

7.2 Login
Some sections of the website are only available to logged-in users and/or allow users to request support or services online by entering personal information. You hereby agree that any information provided to us through such sections is complete and accurate, that you will not log in or attempt to access the Website using the login information of another person, and that you will not adopt a user name that Esperia Volleyball Academy LLC may deem inappropriate.
7.3 Termination of Access to the Website
Esperia Volleyball Academy LLC shall be entitled, in its sole discretion, to terminate or suspend your access to or use of this Website without any prior notice or warning, for any reason whatsoever, including the violation of the terms and conditions or any conduct or behavior which Esperia Volleyball Academy LLC believes to be, in its sole discretion, unlawful or harmful to others.
In the event of termination of use, you will not be allowed to access the Website again, and Esperia Volleyball Academy LLC will use the right to resort to any means possible to implement such termination.
7.4 Indemnification
You agree to indemnify, defend and hold Esperia Volleyball Academy LLC and all of its employees and agents harmless from and against any and all liability, including attorneys' fees and costs, incurred in connection with any claim arising out of any breach by you of these Terms and Conditions.
7.5 Limitation of Liability
Under no circumstances whatsoever, Esperia Volleyball Academy LLC shall be liable for any accidental, indirect, special, or punitive damages that may arise as a result of your use or inability to use the Website, including but not limited to the loss of income or expected profits, loss of reputation, loss of business, loss of data, computer malfunction, or any other damages.

8. Privacy Policy

8.1 Collection of Data. Esperia may collect:

Device IP address, visit time, date, and location;
Pages visited on the website;
Personal data voluntarily provided (e.g., during registration, booking, or communication).

8.2 Use of Data. Data is used for:

Providing services, bookings, and customer support;
Improving website performance and user experience
Sending service updates or promotional information (with the Client’s consent).

8.3 Data Sharing
Personal information will not be shared, sold, or disclosed to third parties without prior consent, except where required by UAE law or government authorities.

8.4 Data Security
Esperia implements technical and organizational safeguards to protect personal information, in accordance with UAE Law.

8.5 Client Rights. Clients have the right to:

Access their personal data;
Request correction or deletion;
Withdraw consent to marketing communications at any time. Requests may be made in writing to Esperia Volleyball Academy LLC.

9. Amendments

Esperia reserves the right to update these Terms and Conditions at any time. Updates will be published on https://www.volley.ae. Continued use of services constitutes acceptance of the revised terms.

10. Acceptance

By registering, booking, or participating in any Esperia activity, the Client acknowledges they have read, understood, and agreed to these Terms and Conditions.
Clients under 18 must have these Terms accepted by a parent or legal guardian.
